La legitimidad del uso de la tortura en la lucha contra el terrorismo

Abstract

A raíz de los atentados terroristas del 11-S se ha puesto en tela de juicio la prohibición absoluta de la tortura y buscado argumentos, tanto éticos como legales, que justifiquen su uso cuando es el único método efectivo para prevenir posibles ataques. Parte de la doctrina se apoya en el paradigma de la bomba del tiempo israelí como justificación del uso de la tortura desde el punto de vista moral, pero no son pocos los autores que consideran injustificable el recurso al tormento en cualquier tipo de situación, pues reparan en las consecuencias que, a largo plazo, supondría la legitimación excepcional de la tortura para los principios del Estado de Derecho. Abstract: In the wake of the terrorist attacks of 11-S , the absolute prohibition of torture has been called into question and arguments, both ethical and legal, have been sought to justify its use when it is the only effective method for preventing possible attacks. Part of the doctrine is based on the paradigm of the Israeli time bomb as a justification for the use of torture from the moral point of view, but there are not a few authors who consider the use of torture in any type of situation to be unjustifiable, since they pay attention to the consequences that, in the long term, the exceptional legitimization of torture would have for the principles of the rule of law.
