La detención: regímen jurídico y derechos y garantías del detenido

Abstract

RESUMEN: El presente trabajo tiene como finalidad el estudio de la detención, resaltando las cuestiones polémicas que suscitó la LO 13/2015, por la que se modificó la LECRIM. Esta reforma supuso un cambio trascendental en las garantías procesales del detenido. Mediante la misma se transpuso al ordenamiento jurídico español la Directiva 2013/48/UE, del Parlamento europeo y del Consejo, de 22 de octubre de 2013, sobre el derecho a la asistencia letrada al detenido.

ABSTRACT: The purpose of this work is to study the detention, highlight the most controversial issues raised by the LO 13/2015, by which the LECRIM was modified. This reform supposed a transcendental change in the procedural guarantees of the detainee. Through the same was transposed to the Spanish legal ordering. The Directive 2013/48/EU of the European Parliament and of the Council, of 22 October 2013, on the right to legal assistance to the detainee.
