Meta-análisis de la reincidencia post-medida en menores infractores en el sistema de Justicia Juvenil español

2022-06Abstract
El éxito de la Justicia Juvenil reside en la adecuada reinserción de los menores infractores,
suponiendo la reincidencia de estos la inefectividad del sistema. En España, trabajos
previos señalan que más de un cuarto de esta población comete un nuevo hecho delictivo
después de haber pasado por el sistema penal. El objetivo del presente meta-análisis es
estimar la tasa de reincidencia post-medida y con ello la eficiencia del sistema de Justicia
Juvenil español, bajo el paraguas legal de la Ley Orgánica de Responsabilidad Penal del
Menor, así como las variables moduladoras que influyen en dicha reincidencia. La
búsqueda bibliográfica ha brindado 17 trabajos, facilitando 48 índices de tamaño del
efecto individuales. De los resultados se extrae que la influencia del tipo de medida
impuesta, la edad, el género masculino, antecedentes en Justicia Juvenil y violencia en la
causa base, actúan como variables moderadoras en la reincidencia. ...
