2020Abstract
En nuestro ordenamiento jurídico se consagra la autonomía de la calificación penal de la insolvencia respecto de la calificación efectuada en sede concursal. Unas mismas conductas del deudor pueden justificar la calificación de concurso culpable y la incoación de un proceso penal por un delito de insolvencia punible. En este estudio se aborda la relación existente entre ambos procedimientos, lo que nos lleva a analizar institutos procesales como la cosa juzgada, la prejudicialidad y la revisión de sentencias firmes.
